2. Counter-Notification

If you believe that the material identified in the DMCA notice was removed or disabled by mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

  • Your Contact Information: Full name, address, phone number, and email address.
  • Identification of the Material: Specify the URL or location of the content that was removed or disabled.
  • A Statement of Good Faith: Include a statement that you believe, in good faith, that the material was removed or disabled due to error or misidentification.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the court in your district or in the location of Winkmod’s headquarters (New Delhi, India) if you reside outside of India.
  • Your Signature: The counter-notification must be signed by you or your authorized agent, either physically or electronically.

Upon receiving a valid counter-notification, we may restore the material in question unless the original complainant files a court action seeking a restraining order against the restoration.

3. Repeat Infringers

Winkmod maintains a policy to terminate, in appropriate circumstances, users or account holders who are repeat infringers. If we determine that a user has repeatedly engaged in infringing activities, we reserve the right to remove their access to our services without notice.

4. Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly misrepresents that content is infringing or that content was removed by mistake may be liable for damages. Winkmod reserves the right to seek damages from any party that submits a fraudulent or misleading DMCA notice or counter-notification.
